Terms and Conditions
1. The Contract
When booking with Access Africa a form must be completed and signed by all persons who will be hereafter referred to as the client. The booking conditions are binding and cannot be varied or waived by any agent, servant, or representative or Access Africa.
2. Payment/Acceptance of Booking
The signed and completed booking form and a non-refundable deposit of 20% of the tour price must be sent to Access Africa. The balance is payable in full 35 days before departure. If not paid the right is reserved to cancel the booking. If booking is made 35 days or less before departure date full tour price is payable.
3. Cancellation/Change of Client
Notification of cancellation must be made via email or fax. If cancelled the following charges will apply: 5% on 60 days prior to arrival, 25% on 30 days, 50% on 15 days and 100% on 7 days or NO SHOW.
4. Cancellation by Access Africa
If a tour is cancelled because the minimum number of passengers are not booked, or for any other reason. The client may choose a full refund or all monies paid or an alternative tour. No further liability by Access Africa to the client with regard to the cancellation will arise. In the event of a passenger selecting an alterative tour which is lower in price, then the client will be entitled to refund of the differences. If the alterative is more expensive then the client will be liable for the additional cost.
5. Unused Services
In the event of a client failing to join a tour, joining after departure, or leaving prior to completion, no refunds or liability will be accepted by Access Africa.
The information in the website, brochure, circular, and other advertisements issued by Access Africa or its agents shall not form part of any contract between the client and Access Africa.
Access Africa does not accept any liability arising out of changes in itineraries, or any other matters due, due to factors outside its control. Including wars, strikes, weather, political disputes, border closures, delayed flights etc. Expenses incurred by the client arising out of these changes are for their own account.
8. Travel Documents
All clients must be in possession of a valid passport, together with any necessary visas or vaccinations, being the responsibility of the client. Information or advise given by Access Africa regarding the above is given in good faith, but Access Africa cannot accept responsibility for any information given. Should a client be refused entry into a country due to incorrect or incomplete documentation, Access Africa will not be held liable for any costs of such delays or reparation costs for the client.
9. Authority on Tour
At all times the authority and decision of the tour leaders will be final on all matters likely to endanger the safety and well being of the tour.
Should a client, in the sole opinion of Access Africa, or it duly authorized representative, be considered unsuitable to the tour, due to being in contravention of any customers or laws of the country, or by reason of causing inconvenience or annoyance to other passengers, then Access Africa may decline to carry such client any further and will not be able to make any refund, and no other liability by Access Africa to the client will arise.
11. Limitation of Liability
Clients undertake all tours and associated expeditions entirely at their own risk while understanding that certain risks exist being an adherent part of African Travel. Every precaution is undertaken to ensure clients safety, and no responsibility can be accepted for death, injury or loss sustained, from any cause whatsoever. The client and his/her dependants, heirs, executors, administrators or assigns, hereby indemnify and old blameless Access Africa, or its members, employees, representatives and agents from any claims of whatsoever nature and from any liability for delay, loss, damage, injury, illness, or death, arising form any cause whatsoever out of events related to or occurring during a tour.
12. The Contract
This contract, by whosoever and wherever it is made, is subject to and shall be governed and construed according to South African law.
13. Claims and Complaints
Complaints against Access Africa must firstly be taken up with the tour leader, in order to remedy the problem. If the client has any further complaints they must be lodged via e-mail or fax to Access Africa within 28 days.
14. Price Increases
Access Africa reserves the right to increase tour prices due to any increase in fuel costs, park entry fees, or fluctuation of exchange rates.
It is compulsory for all clients to effect appropriate travel and cancellation insurance, which must be for the full duration of the tour, covering cancellation, curtailment, medical, emergency travel, and personal accident.
